The following are cases of contravention under the Private Education Act and/or the Private Education Regulations.

Conviction
The accused was convicted and sentenced for:
 
1) Failing to ensure that Process College complies with a lawful direction to refund students their course monies.  This is an offence under section 60(2)(a) read with section 60(5) and punishable under section 61(2) of the Private Education Act Cap 247A.  The Court imposed a four (4) week jail term. Her appeal to the High Court was dismissed.
 
2) Failing in her duty as manager to ensure the keeping of proper student records.  This is an offence under section 41(1)(a) read with Section 41(3) of the Private Education Act Cap 247A. The Court imposed a fine of $5,000 and in default two (2) weeks jail.

Regulatory Cancellation of Registration
Fortune School of Technology and Management’sregistration was cancelled under section 38(1) of the Private Education Act (the “Act”) for the following reasons:
 
1) The private education institution has ceased to provide private education; and
 
2) The private education institution or any manager thereof is contravening or has contravened the Act.

The accused was convicted and sentenced for failing to comply with a lawful order to produce documents required for inspection by the CPE. This is an offence under section 62(1) read with section 62(4) of the Private Education Act Cap 247A. The Court imposed a fine of $4,000 and in default four (4) weeks jail.
